UN Rapporteur Commends Brazil’s Migrant Protection Framework
The United Nations Special Rapporteur on the human rights of migrants, Gehad Madi, has lauded Brazil’s migration framework for its robust protections for refugees and asylum seekers. During his 10-day visit to the country, he highlighted how the framework guarantees equal fundamental human rights to individuals irrespective of nationality. Madi emphasized the importance of ensuring that the implementation of these laws aligns fully with international human rights standards.
Legal Framework Promotes Regularization for Migrants
In his assessment, Madi noted that Brazil’s legal migration framework facilitates a safe pathway to regularization for migrants, refugees, and asylum seekers. He pointed out that this legislation ensures equitable access to essential services, including healthcare, education, labor protections, and social security. Such provisions reflect Article 5 of the Brazilian Constitution, which underlines the commitment to human rights for all individuals within the country.
Human Rights-Centric Approach Stands Out
Madi underscored that a significant strength of Brazil’s immigration policy lies in its human rights-based and non-punitive approach. Measures such as decriminalizing immigration, classifying illegal entry as an administrative offense, and issuing humanitarian visas exemplify this philosophy. He noted Brazil’s “open approach” to migration sets it apart as a leader in South America, especially when compared to the increasingly stringent immigration policies observed in regions such as Europe and North America.
Challenges Persist for Refugees and Migrants
Despite the commendable framework, Madi identified communication and bureaucratic barriers that continue to hinder the experience of migrants and refugees. He expressed particular concern for Cuban nationals, who often have limited pathways to migration and face low recognition rates for asylum applications, despite a surge in requests.
Critique of Asylum Application Restrictions
Madi raised concerns regarding a policy that prohibits asylum applications from individuals arriving at Guarulhos International Airport on connecting flights without a Brazilian visa. This measure was implemented in response to the misuse of Brazil as a transit point for irregular migration and the exploitation of the asylum system by criminal organizations.
Recommendations for Enhancing Legal Protections
Experts have suggested actionable steps for aligning Brazil’s migration policies more closely with international human rights standards. Recommendations include increasing funding to support immigration policy implementation, expanding the capacity of both the Federal Police and the National Commission for Refugees (CONARE) to streamline asylum decision-making, and enhancing the presence of CONARE at international airports to ensure proper assessment and acceptance of asylum seekers.
Brazil’s Comprehensive Immigration Legislation
Brazil enacted a comprehensive immigration law on May 24, 2017, in response to a rising number of migrants as countries in the Global North tightened restrictions. This legislation established a robust legal framework for migration control, promoting the documentation and regularization of migrants in line with the Brazilian Constitution, while bolstering the human rights of migrants. In conjunction with this law, Brazil initiated Operation Welcome in 2018, a humanitarian effort aimed at supporting Venezuelan refugees facing vulnerabilities.
