Federal Investigation Targets Fairfax Prosecutor’s Immigration Policies
FAIRFAX, Va. – A Virginia prosecutor has accused the Trump administration of initiating a politically motivated investigation into his office’s handling of cases involving defendants with uncertain immigration status. This allegation follows the Justice Department’s scrutiny of the Fairfax County U.S. Attorney’s Office regarding its policies on charging and sentencing individuals who do not have permanent legal residency.
Accusations of Partisan Abuse of Power
On Thursday, U.S. Attorney Steve Descano criticized the federal government’s actions, claiming they exemplify a pattern of using the Department of Justice for partisan attacks. In a statement, Descano’s office called the investigation a distortion of their established policies, which have been transparent for over five years.
Investigation Coincides with Congressional Testimony
The timing of the investigation has raised further questions. Just one week prior to Descano’s scheduled testimony before the House Judiciary Subcommittee on Immigration Integrity, Security, and Enforcement, the Justice Department announced its inquiry into the local prosecutor’s plea agreements and sentencing practices.
Allegations of Discrimination Against U.S. Citizens
The Justice Department’s Civil Rights Division stated that it will examine whether the prosecutorial policies unfairly favor immigrants at the expense of American citizens. Assistant Attorney General Harmeet K. Dhillon emphasized the commitment to preventing any discriminatory practices by local authorities regarding immigration status.
Implications of Fairfax Prosecutor’s Policy
In December 2020, Descano’s office implemented a policy requiring attorneys to consider the immigration status of defendants when making charging decisions. The Justice Department is investigating whether this approach violates Title VI of the Civil Rights Act or the Safe Streets Act, both of which prohibit discrimination based on race, color, or national origin.
Ongoing Criticism and Concerns
Critics have voiced concerns about Descano’s policies for some time. Sean Kennedy, policy director for the Law Enforcement Legal Defense Fund, stated that individuals are not being prosecuted to the fullest extent of the law. The organization has communicated its concerns to the Justice Department, arguing that Descano’s policies allow undocumented immigrants to evade accountability for serious crimes.
Recent Cases Raise Alarm
Specific cases have amplified the discussion surrounding Descano’s policies. The Police Law Enforcement Fund pointed to incidents involving Honduran nationals charged with illegal entry, who were reportedly allowed to pause their deportation appeals while accumulating multiple criminal charges from 2021 to 2023. These cases included serious felonies that were subsequently dismissed or reduced to misdemeanors, which would impact deportation eligibility.
Calls for a Comprehensive Investigation
The Department of Homeland Security has also weighed in, particularly after the tragic killing of Stephanie Minter at a Fairfax bus stop. The man charged with her murder, Abdul Jallow, has been in the U.S. illegally since 2012. Kennedy has called for a thorough examination of these procedures to ensure justice and accountability in light of these serious issues.
