Social Circle Initiates Legal Action Against ICE
Social Circle, Georgia, has filed a lawsuit in federal court in Macon against the U.S. Immigration and Customs Enforcement (ICE) regarding the proposed establishment of an immigrant detention facility in the city.
Allegations of Legal Violations by Federal Authorities
The lawsuit asserts that federal authorities have acted unlawfully by planning to convert an existing storage facility in Social Circle into a detention “mega center.” The city contends that ICE proceeded without adequate consultation with local officials and failed to consider the significant issues that the facility would introduce.
Concerns Over Infrastructure and Capacity
With a population of approximately 5,000 residents, Social Circle voices its inability to support the infrastructure demands of a 10,000-person facility, which would effectively triple the city’s population. The city is particularly concerned about the potential strain on its water supply and sewage systems.
Impact on Water and Sewage Systems
The complaint highlights that the proposed facility would greatly exceed the city’s wastewater processing capacity. Currently, the wastewater system can handle 660,000 gallons per day; however, the facility is expected to require more than 1 million gallons daily. This discrepancy raises alarms about possible shortages of fresh water and unsafe sewage overflow.

Social Circle’s lawsuit claims that the government’s plan violated the National Environmental Policy Act (NEPA) and the Administrative Procedures Act (APA). These regulations are meant to ensure transparency, rational decision-making, and the analysis of feasible alternatives by federal agencies. The city argues that federal authorities have disregarded these critical legal requirements.

In an effort to address these concerns, the city has taken drastic measures, including locking water meters for warehouses since March. These actions underscore the urgency of their infrastructure worries amidst the ongoing legal battle over the proposed detention facility.
Latest Developments on the Facility Plans
Before the lawsuit was filed, plans for the facility were already in flux. Reports indicated that the Department of Homeland Security (DHS), which oversees ICE, had suspended conversion efforts of the warehouse in early April. The city also reported cancelation of a scheduled meeting with DHS, further adding uncertainty to the situation. In late April, it was revealed that several warehouse conversions were facing delays due to environmental impact assessments, although it remained unclear if Social Circle was among them.
Nature of the Lawsuit and Government Response
The 31-page complaint requests a judicial ruling to declare the government’s decisions about warehouse immigration detention facilities unlawful, asserting violations of NEPA, APA, and state law. Additionally, the city seeks to prevent the federal government from further efforts to convert these warehouses into detention centers. As of Thursday, the government had not provided a response to the lawsuit.
