ACLU of Georgia Files Complaint Against Immigration Officials on Behalf of Double Amputee
ATLANTA — The American Civil Liberties Union (ACLU) of Georgia has submitted a complaint under the Federal Tort Claims Act (FTCA) against the Department of Homeland Security and Immigration and Customs Enforcement (ICE) on behalf of Rodney Taylor, a 47-year-old father and double amputee who has lived in the U.S. since he was two. Taylor was detained by federal immigration authorities in early 2025 while his two young children watched, only to be subsequently denied essential medical care during his time in ICE custody at the Stewart Detention Center. This legal action is part of a nationwide initiative by the ACLU, involving 53 claims spread across 17 states and Washington, D.C.

Since the onset of President Trump’s second term, federal law enforcement has displayed a troubling disregard for established legal norms, causing widespread fear in communities and among those in custody. The consequences of these actions have been dire; the death rate in ICE facilities has more than doubled since Trump’s inauguration, reaching its highest level in over a decade. Recent reports highlighted that ICE detained over 10,000 individuals within just five days, following a White House directive to ramp up arrest rates. Tragically, this surge in enforcement has led to fatalities, with incidents such as the shooting of Lorenzo Salgado Araujo by ICE agents in Texas and the killing of Johan Sebastian Duran Guerrero in Maine, both of which raised alarms about the aggressive tactics employed by immigration officials.

Taylor’s situation serves as a stark example of the consequences that arise when ICE fails to provide fundamental care for those in its custody. He endured more than a year in detention, during which he was systematically denied medical treatment and accommodations for his disability. The lack of proper care resulted in significant pain and lasting harm to Taylor’s health, highlighting the urgent need for reform within ICE facilities.

“This lawsuit addresses the brutality of ICE. Mr. Taylor’s experience in custody is not only unlawful but also profoundly tragic. He suffered greatly, was denied critical medical attention, and his needs went unacknowledged. For over a year, he lived in anguish, which has taken a heavy toll on his body, mind, and spirit. His livelihood and life have been irrevocably altered. Like many others affected by ICE, Mr. Taylor deserves justice, and it is imperative to hold the Trump administration and ICE accountable,” stated Selena Premsey, a staff attorney with the ACLU of Georgia.

In response to the misconduct of the Trump administration, ACLU affiliates across the nation are leveraging the FTCA as one of the few legal means available to seek financial redress for abuses by federal employees. Each of the 50-plus complaints filed reveals a unique narrative of individuals victimized by ICE agents. Examining Immigration Enforcement Practices
Earlier this month, the ACLU released a report titled “Agents of Chaos and Cruelty,” which scrutinized immigration enforcement actions during the first year of Trump’s second term. The analysis covered over 1,200 cases in eight states and found that more than 400 involved illegal actions by immigration officials, including excessive force, racial profiling, and various forms of abuse and intimidation.
