Federal Judge Orders Release of Louisiana Man Detained by ICE
In a decisive move, a federal judge has mandated that U.S. Immigration and Customs Enforcement (ICE) release 77-year-old Akram Mahmoud Omar, who suffered a heart attack while in ICE custody. This ruling comes after a rigorous legal battle highlighting the treatment of vulnerable detainees within the immigration system.
Detainee’s Troubling History with ICE
Omar had been a resident of the United States for 50 years before ICE detained him during a routine inspection last October. Following his arrest, he was taken to Camp 57, an ICE facility located within a state prison in Angola, Louisiana, where the harsh conditions of confinement worsened his health, culminating in a heart attack, as outlined in a habeas petition he filed in April.
Immediate Legal Action After Re-Detention
Following a ruling on May 29 that found ICE had violated Omar’s constitutional rights, the federal judge ordered his immediate release. However, in a troubling turn of events, ICE re-arrested him just ten days later, attempting to expedite his deportation despite his ongoing recovery, according to his attorney, Ken Mayo.
Court Intervenes Again to Prevent Deportation
Responding to an emergency motion by Mayo, the judge reiterated that ICE must refrain from re-detaining or deporting Omar. In a court order dated Monday, Judge Brian Jackson emphasized the need for compliance, stating, “U.S. Immigration and Customs Enforcement (ICE) shall immediately release Mr. Omar from ICE custody.”
Ongoing Legal Concerns and Allegations
The emergency motion asserted that ICE acted in blatant disregard of judicial orders by detaining Omar without prior notice of deportation. Mayo’s documentation highlighted that ICE misled Omar and his family regarding their obligations, claiming they need not report to ICE until December, only to rush the deportation process just hours later.
ICE’s Pattern of Alleged Judicial Disregard
Bridget Pranzatelli, an attorney with the National Immigration Project, condemned ICE’s repeated violations of court orders as indicative of systemic issues within the agency. She noted that such disregard for the authority of federal courts seems to be becoming commonplace, posing significant risks for individuals like Omar, who is already facing serious health challenges.
Health Risks Intensified by Deportation Attempts
Omar’s health remains precarious following his heart attack and surgery last April. Doctors have expressed concern that his condition makes him unfit for the rigors of a deportation flight. Mayo highlighted that ICE’s actions could have dire consequences for the elderly detainee’s well-being, underscoring the urgency of adhering to judicial mandates established to safeguard vulnerable individuals.
