Washington Immigration Lawyer Faces Federal Malpractice Lawsuit
A Washington-based immigration attorney is embroiled in a federal civil malpractice lawsuit brought forth by nine former clients. The plaintiffs allege that Alexandra Lozano made unrealistic promises regarding their immigration cases, only to engage in deceptive and negligent practices.
Allegations of Deception and Fraud
Court documents reveal claims that Lozano misled clients and immigration authorities alike. Some clients assert that false statements were submitted on their behalf without their awareness or consent. For instance, plaintiff Nora Patricia Murillo Moreno sought Lozano’s assistance after being sold on a supposed “miracle” that would secure her a green card, influenced by her husband and three children’s U.S. citizenship.
Pressured to Misrepresent Facts
Murillo Moreno recounts that Lozano pressured her to fabricate details and make claims she was uncomfortable with. Court documents indicate that Lozano allegedly filed and signed a declaration on Murillo Moreno’s behalf filled with exaggerations and potentially falsehoods. This situation unfolded while Murillo Moreno was frequently traveling to Mexico to care for her ailing father.
Unexpected Denial and Lack of Communication
Upon returning to the United States from one of those trips in February, Murillo Moreno was stopped at the border and informed that her residency application had been denied. She was stunned to learn that Lozano had never communicated this denial or informed her about a critical court hearing she was supposed to attend. In her desperation, she pleaded with immigration officials for a chance to present her case in court, lamenting her lack of belongings.
Experiencing Separation and Hardship
Since then, Murillo Moreno has remained in Mexico, grappling with the emotional toll of being separated from her children. “What’s really hard is my sons. Being away from them,” she shared, emphasizing the personal anguish stemming from the situation.
Widespread Claims of Negligence
In addition to Murillo Moreno, the lawsuit includes eight other former clients who accuse Lozano of providing illusory and negligent services that bordered on fraud. Allegations extend to Lozano’s actions in fraudulently requesting visas for clients who were unqualified, including under the Violence Against Women Act (VAWA) and the Trafficking in Persons (T-Visa) program, both designed to protect vulnerable populations.
Legal Counsel Responds to Ongoing Inquiries
According to Aric Bomsik, an attorney representing the plaintiffs, numerous individuals have since come forward with similar concerns. “We’ve had dozens of people contact us, and we’re still receiving new inquiries,” he stated. Vicente Omar Barraza, another attorney on the case, underscored the emotional burdens faced by the affected individuals, many of whom have invested over $15,000 in hopes of achieving the American Dream, now turned into a distressing ordeal.
Lozano’s Stance on the Allegations
In response to the lawsuit, Lozano expressed serious concern over the allegations and reiterated her longstanding commitment to immigrant advocacy. She noted that her nearly two-decade career has focused on providing support in complex legal situations. Additionally, she highlighted the significant shifts in immigration law in recent years, attributing some struggles to changing policies under the current administration.
